Lawyers for NBA star Shaquille O\u2019Neal, who previously endorsed the now-bankrupt crypto exchange FTX, have claimed two process servers inadequately delivered legal documents after previous failed attempts.<\/p>\n

In a May 8 filing for the United States District Court in the Southern District of Florida, O\u2019Neal\u2019s legal team said following \u201ca failed motion to serve\u201d the NBA star, two process servers \u201ctossed\u201d papers for a legal complaint in front of his moving car. According to the filing, O\u2019Neal did not stop to pick up the papers but left them in the road.<\/p>\n

\u201cThis purported \u2018service\u2019 is inadequate under Rule 4 of the Federal Rules of Civil Procedure and Georgia law,\u201d said the filing. \u201cIt should be quashed, and the claims against Mr. O\u2019Neal dismissed.\u201d<\/p>\n

O\u2019Neal was one of many high-profile figures who endorsed FTX before its bankruptcy filing in November 2022. The NBA star appeared in a commercial saying he was \u201call in\u201d for the crypto exchange. Following the exchange\u2019s collapse and facing potential legal action, O\u2019Neal reportedly said he was \u201cjust a paid spokesperson\u201d for the firm.<\/p>\n

In November, the Moskowitz law firm filed a class-action lawsuit on behalf of Edwin Garrison and other FTX investors against celebrities and sports figures for promoting the exchange. A similar lawsuit filed by the same firm in March targeted crypto influencers, including YouTuber Ben Armstrong, also known as BitBoy Crypto, who allegedly promoted FTX\u2019s \u201ccrypto fraud without disclosing compensation.\u201d<\/p>\n

Moskowitz reported on April 16 that O\u2019Neal had been served with the legal complaint outside his house following several unsuccessful attempts. The law firm did not specifically mention delivering the documents to the NBA star in his car or otherwise throwing them.<\/p>\n

\u201cAs Mr. O\u2019Neal \u2014 who never exited his car \u2014 drove past the strangers lurking outside his home, one of the process servers \u2018tossed the legal documents at the front of\u2019 his car,\u201d said the May 8 filing. \u201cWhen the documents hit the car, which was moving \u2018at a high rate of speed,\u2019 the documents \u2018f[e]ll onto the road,\u2019 and the process servers \u2018l[e]ft the legal documents on the road where they landed\u2019 \u2014 that is, on the public road.\u201d<\/p>\n

According to the filing, this alleged method of serving legal documents was \u201cinsufficient under Georgia law\u201d and inadequate:<\/p>\n

\u201cThrowing papers at a moving car and leaving them unattended on a public highway \u2018is not good tender as it provides no way of knowing whether the papers landed in physical proximity to\u2019 Mr. O\u2019Neal.\u201d<\/p><\/blockquote>\n

Moskowitz has received authorization from the court to serve other individuals connected to the lawsuit, including by tweet in the case of crypto YouTuber Tom Nash.<\/p>\n
